On May 22, 2024, Colombia partially amended Decree 1165 of 2019, which regulates foreign trade and the competences between the legislative and executive branches in customs matters.

The decree is based on numeral 25 of article 189 of the Political Constitution of Colombia, and on the development of the customs framework laws, which are established as general rules to regulate foreign trade and the competences between the legislative and executive branches in customs matters.

What did the amendment consist of?

The amendment to the decree seeks to facilitate foreign trade by optimizing customs processes, specifically through the implementation of the advance import declaration. The advance declaration makes it possible to obtain prior information on the goods, improving control and facilitating foreign trade.

The decree emphasizes the responsibility of customs officials and trade operators to prevent corruption and smuggling, in line with Law 1609 of 2013.

Strategic analysis of the new Decree:

  • Control and Transparency: The emphasis on supporting documentation, electronic computer systems and customs seals points to strengthening customs control, reducing corruption and improving transparency in operations.

  • Transparency and Compliance: The categorization and specification of responsibilities increase transparency and regulatory compliance, reducing risks of tax evasion and fraud.

  • Trade Facilitation: The measures seek to facilitate international trade by clarifying procedures and improving efficiency in the handling of goods.

The amendments to the new Decree are designed to improve efficiency, control and transparency in Colombia's customs management, aligning with international standards and promoting a more competitive and safer environment for foreign trade, in order to combat and control international illicit trade.
